Also unless you’re a fascist like Trump you don’t sick your appointment to the US Attorney General position and DOJ on anyone, let alone a political opponent. Garland and the Smith indeed did investigate and ultimately charge Trump – but independently of some sort of Biden directive.
They couldn’t bring it to trial because Trump had already previously stacked the courts, who blocked Smith at every turn.
It’s not; it just has to fall within the purview of the rule of law and also not jeopardize the trial by tainting the jury or getting the case thrown out.
